The possibility of being arrested probably never occurs to most people. This happens, however. Lots of people that lead ordinary lives land up in situations that they have either not foreseen or that are the result of errors of judgment. Being arrested can be extremely embarrassing and the consequences can be far reaching. Every person that is arrested has the right to apply to the court for release. In most cases this application is granted, provided that the accused undertakes to observe the conditions set by court. Prior to release a cash deposit must be paid, however. This deposit serves as surety that the accused will show up for his trial. This deposit is forfeited if the accused do not observe the conditions of release.

In some cases the court will not entertain an application for release. Repeat offenders are often kept in custody, as is accused that committed particularly violent crimes such as rape, assault and murder. Accused that are mentally unstable and that may pose a danger to others if released are also kept incarcerated. In some cases accused are kept in custody because their own lives may be in danger if they are released.

When people are arrested they seldom have enough cash on them to pay the deposit that is required before they can be released. This is when the services of bondsmen can be invaluable. They specialize in providing instant cash loans to arrested people. The money is made available immediately but the accused will have to pay a fee equal to roughly ten per cent of the loan amount.

Disregarding the release conditions stipulated by the court can have very serious consequences. Those in breach will almost certainly be arrested again. This time round they will not qualify for release until their cases have been heard by court. This can have a detrimental effect on the career and family life of the accused. If the contract with the bondsman is not honored, the accused may see his assets confiscated and sold on auction.

Critics of the system maintain that it is a big mistake to allow any accused people to go free, even if it is just until their court dates. They say that the system perpetuates crime and that it favors criminals while ignoring the safety of law abiding citizens. However, there are a large number of arrests each year and it is simply not practical to keep every arrested person in prison for extended periods.

Critics should keep in mind that the constitution stipulates that every accused person remains innocent in the eyes of the law until they are found guilty by a court of law. Numerous cases are dismissed out of hand and a large percentage of arrested people pose no danger to society. It would be unfair, illegal even, to keep them in custody for long periods without a trial.

When arrested it is important to try and remain calm. It is best to say nothing and to wait until the advice of a lawyer has been obtained. The lawyer will make sure that he applies for bail as quickly as possible. Once released the accused must be very careful to avoid interfering with the case and to cooperate with the authorities.
